End of the Line for Boise Trolley Tours

It's official, the Boise City Attorney's office told Debra Miller that her lease is revoked, and if she tries to operate her trolley tour, she'll be cited for violating city code of peddling in a park without a license. The letter said Jim Hall, director of the Boise Department of Parks and Recreation reviewed e-mails and correspondence, accusing Miller of rude, profane and disrespectful" conduct and language. The formal notice said that the city could seize any of Miller's property used in violation of the order. Here's a copy of the letter.

figures, normal good government bullshit! As usual, let government take over and everything gets fucked up. All they are good for is putting decent people and small business OUT OF BUSINESS! the FIRST person who should be fired is the fucking City Attorney.....talk about ABUSE of POWER. Someone should shoot his ass with a pellet gun and wake him up to the realities of the world. Get a life City Attorney J. Patrick Riccci. You OBIVIOUSLY dont have one here!

yep, so much for the first amendment, huh? what happened to Freedom of Speech? That is still the FIRST and Basic right we were granted. I'm sorry but being rude and/or swearing is STILL LEGAL in this country.....whether some ASSHOLE like the city attorney likes it or not. If I was Ms. Miller I would sue the city on those grounds alone. The First Amendment is our RIGHT TO SPEAK AS WE CHOSE.....swearing and otherwise. Plus it is HER business and she the RIGHT to run it as SHE SEES FIT! When this city and the city attorney's office starts paying her bills and running her business for her then they have the right to state otherwise. Until then....BUTT THE FUCK OUT! Mind your own god damn business....instead of sticking your nose into shit you have NO business being involved in!

To all of the persons who have commented on this ongoing story, have any of you gone down to Julia Davis Park and watched how Ms. Miller conducts/conducted her business? I had family in town earlier this month on their first visit to Boise and thought it would be great to take them on the Trolley tour. Having taken other family members on the "Train" tour years ago, I thought it would be similar. What a disappointment this tour turned out to be. When we arrived at the park, there were two BPD cruisers and several officers attempting to ascertain what Ms. Miller was having such a hissy fit about. Apparently she felt that because she had a little sign posted that the picnic tables were for her customers only, she could have anyone else evicted. There were no other people "waiting" to sit down, or waiting for the Trolley. There was a small family of two adults and several small children sitting at one of the picnic tables. Big deal! I found Ms. Miller to be extremely rude. As for her comment about taking a brown bag lunch to McDonalds, that isn't even in the same ballpark. McDonalds is a business conducting their business on their property, not in a public park. As the saying goes, you can catch more bees with honey than you can with vinegar. I would never recommend or take anyone on the Trolley tour again. It was very expensive and not worth the money. By the way, I was unaware that Ms. Miller was going to be running for a political position. So much for getting any votes from people who have witnessed her tirades. As far as comparing her "Trolley" to Mayor Bieter's trolley, they are not even remotely the same.

Your arguing Freedom of Speech? Seriously? She is operating a business on public property as allowed by a lease from the city. If the property owner, which is the city on behalf of the public, want to revoke the lease, they can do so.

If you were a building owner and wanted to revoke the lease of a tenant who is violating terms of a lease, you could do so. It is your right as a property owner.
They are not restricting her speech, they are revoking permission for her to operate a business on public property. The city is our representative and regardless of what you think, they do have the right to stop someone from operating a business in our parks.

Regardless of anything else in this story, get a clue before you start spouting out civil rights violations that don't fit. You have a computer, do some research. Read some books. It makes you sound silly and makes the rest of us who do takes our rights seriously look bad.

That is neither have the Boise Police conducted themselves in an upstanding, with unquestionable morals...I mean they can keep such articulate records for their defence, but destroy what reflects poorly or manipulate...Never the glimpses of truth you had privy too...just like that gut feeling when you know your mate has been cheating!

freedom of speech doesn't mean "i can say whatever i want when i want to" it means that we have the right to seek, impart, and receive information and ideas. rude profanity and vulgarity defeats the purpose of 'free speech'

The 1st amendment wasn't intended to protect your mouth from any accountability. I agree that freedom of speech should be protected, but having said that, alot of people take the trolley ride on there visits to Boise, (some business owners looking to expand) and they get this rude, ranting, lunatic, taking them and their families on a tour of our city. The goverment actually did the right thing here.
Freedom of speech doesn't apply here. Can you yell "bomb" on an airplane? Can you yell "fire" in a theatre and not be responsible if someone gets hurt in the stampede?

I took this tour and I enjoyed it. Ms. Miller displayed no rudeness whatsoever the day I took the tour. Just saying...

Angry , You obviously are ignorant of Real estate law. When the city LEASES a premises they GIVE UP THEIR RIGHTS in lieu of Compensation to the Terms of the lease. They also GIVE UP CONTROL. They are in default of these terms and they will be accountable to any damages incurred.

Concerned citizen,
When the City of Boise enters into a Commercial lease they give up there "PUBLIC INTEREST" in lieu of Private Enterprise and Commercial gain and are compensated for use of the space. They give up their rights for yes...duh, $$$$$.
So you see, your Marxist Mayor wants cash like the greedy Capitalist Trolley company (me) trying to make an honest living. At least I'm up front about it. They are just hypocrites about it. I have a RIGHT to say who occupies MY SPACE that I"m paying for.
How bout if I come over and sit on your couch tonight and have a beer and watch your tv? Why don't you leave the door unlocked? I'll be right over! Where'd ya say you live?

Ya know what Cherenkov?? I don't think so. I'm in TOURISM., and Tourists ain't from Boise! I have clients from all over the World. I'm still in business here. Nobody is shutting me down. Just cause that Lame Ass Parks Dept. doesn't know how to honor a Lease agreement doesn't mean squat. I think you need to go take your bag lunch over to Bardenay in the Basque Block& Give them a taste of your crap. See how far you get with them.

this lady is a little crazy, i watched her lose her temper over some people trying to eat at one of the picnic tables. Seating was not in short supply at all, they were the only people near the trolley station.. and she kicked them out.. I over heard one of the picnicking people say that they worked behind the trolley station and they always take there lunch break at that table when it was warm enough, " this was last summer when she first opened up". But she decided to treat them like freeloaders and kicked them out. They could of vary easily became steady customers, but she didn't care to see that.

I also overheard/saw an interaction with this lady and a customer of hers. The customer had just taking to trolley tour and had a few complaints, he wasn't being rude. He just seemed a little confused as to why the price of the trolley had gone up since the year before and why the tour was significantly shorter. When the customer asked her these things the two of them were still surrounded by people getting off the trolley, in the crowd and feeling like she was being "called out" in front of her last load of customers she immediately became really defensive and started using a yelling tone. She did not let up until the customer speed walked away. I still feel bad for that guy.
