Idaho Supreme Court: No 'Right of Visbility'

The former owners of the Holiday Inn near the Boise Airport were unsuccessful in defending what they called a "right to visibility," saying an extended construction project that widened Vista Avenue hurt the hotel business.

The Idaho Business Review reports that the Idaho Supreme Court ruled that visbility is not expressly recognized as a property right in Idaho.

The hotel owners had sought more than $7.5 million in damages, but the State of Idaho only offered $40,000 for the inconvenience.

The former owners filed their lawsuit in 2009, but have since lost the hotel in foreclosure. New owners have since taken over and reopened the hotel.
