Luna Law Opponents Take Grievance to Court Today

Posted By on Thu, Aug 25, 2011 at 8:57 AM

Opponents of the so-called Luna laws will their day in court today, at least to challenge one of the three measures passed by the 2011 Idaho Legislature that overhaul the state's education system.

Senate Bill 1108 changes the law when it comes to negotiations between local school districts and teachers' unions, and does away with continuing contracts for new teachers. A lawsuit, spearheaded by the Idaho Education Association, claims SB 1108 "compromises fundamental provisions of the Idaho State Constitution by violating the single-subject rule, reneging on vested rights, and by forcing school district to breach existing contracts."

The hearing, scheduled for this afternoon, will be before District Judge Timothy Hansen at the Ada County Courthouse.
