HP Wins Court Battle Over Oracle

Posted By on Fri, Aug 3, 2012 at 9:13 AM

Hewlett-Packard won a major court victory Wednesday—potentially worth hundreds of millions of dollars, according to one source—in its effort to force Oracle to continue making software for one of HP's server lines.

Santa Clara (Calif.) County Superior Court Judge James Kleinberg ruled that Oracle ignored a "clear and unambiguous" deal by pulling the plug on software for an HP server. The ruling also cleared the way for a second trial to determine damages. HP claimed it lost more than $500 million when Oracle stopped making the software.

Brian Marshall, an analyst with the International Strategy and Investment Group, wrote that the judge's ruling was "a huge win for the beleaguered HP" and "welcome news" for HP customers.

But Oracle quickly announced that would appeal the decision.
