Spokesman-Review: Suit Filed Against Idaho Ban on Same-Sex Marriage

Idaho's constitutional ban on same-sex marriage is being challenged in court, after four Boise couples filed a federal lawsuit challenging the statute and other laws which disregard same-sex marriages performed in other states.



According to the Spokesman-Review, the suit—filed this morning and naming Idaho Gov. C.L. "Butch" Otter and Ada County Recorder Chris Rich—charges the state's prohibition of same-sex marriage runs counter to due process and equal protection rights granted in the U.S. Constitution.



The four couples behind the lawsuit—all women—are being represented by Boise attorneys Deborah A. Ferguson and Craig Durham of the National Center for Lesbian Rights. Three of the four couples are raising children.
