Final Responses, Motions Expected Today on Idaho Same-Sex Marriages

This is where we last left the ever-changing legal status surrounding Idaho's ban on same-sex marriage.

Late Friday night, Oct. 10, the 9th Circuit Court of Appeals received a late-night motion from attorneys representing three Idaho couples to "dissolve the stay" and lift the final gate to allow same-sex unions to proceed.

The 9th Circuit has allowed Gov. C.L. "Butch" Otter and Attorney General Lawrence Wasden until 1 p.m. Mountain Time today (Monday) to respond to the motion filed by attorneys Deborah Ferguson, Craig Harrison and Shannon Minter on behalf of the Idaho same-sex couples. 

Then, presuming that Otter and Wasden file such a response, the plaintiffs may also file a reply to the State's response by 6 p.m. Mountain Time, also today (Monday).

Simply put, a final decision may come down this evening or early Tuesday.
