Bravo! I cannot tell you how many times I have had this conversation with PSR workers, therapists and PCS providers. Has anyone ever asked if this widely accepted practice is legal with the Idaho Department of Labor or the the USDOL? If mental health care providers are required by law (IDAPA) to perform these functions (notes, reviews, collateral contacts, etc) then why are our employers not, by law, required to pay the employee for them. I understand the employer will not be able to recive any compensation for these services, but isn't that just the cost of doing business??? They do not receive compensation to clean their bathrooms, but they still pay someone to do it. Is there something I am missing? If these employees are not salaried exempt (which a therapist can be, but not a PSRW) then the employer by law needs to compensate then for work performed or am I missing something?
