In 1942 FDR issued an executive order which effectively imprisoned over 100,000 people of Japanese decent, most of them US Citizens. This was done during a time of high emotion, and even though it violated the law, "everybody knew" it was just the right thing to do.

This is not a pro/anti gay marriage comment, but a warning: Do we really want our executives making the decision to not vigorously defend certain laws based upon popular sentiment? What if the next law under attack was something you wanted to see enforced, but the governor decided that it was easier to go along with popular sentiment?

There is a mechanism to change Idaho's constitution - wouldn't it be much better to change it there than in the courts?
