Prosecutor Clears Boise Officers in September Police Shooting 

A prosecuting attorney has cleared three Boise police officers of wrongdoing in the September 2017 shooting of then-22-year-old Dakota Morris, according to a Feb. 22 Boise Police Department press release.

The decision came from Twin Falls Prosecuting Attorney Grant Loebs, who based his determination that the officers' actions were justified on a Critical Incident Task Force investigation into the incident that was led by the Ada County Sheriff's Office.

Just before midnight on September 19, 2017, Boise Police officers were called to the Jack in the Box on Fairview Avenue and Maple Grove Road, after police received a call about two people "acting suspiciously" at the fast food restaurant. Upon the arrival of the officers, a male suspect—Morris—ran from the scene.

Police chased the suspect through several parking lots before the suspect brandished a handgun, according to investigators. The suspect continued to display the firearm as additional officers arrived on the scene and made repeated verbal commands. Police said Morris leaped a fence into another parking lot. Officers said they fired on Morris after a confrontation. A black Ruger handgun was later found near the scene, believed to have belonged to Morris.

Morris survived the incident and was taken to Saint Alphonsus Regional Medical Center for treatment. He has since been charged with felony assault or battery upon certain personnel with a felony enhancement for use of a deadly weapon in commission of a felony. Morris was also charged with a felony count of unlawful possession of a weapon by a convicted felon, and misdemeanor resisting or obstructing officers. A jury trial is scheduled slated for this May. Due to Morris' ongoing legal battle, investigators said additional details about the incident, including body camera footage, are unavailable.

The officers involved in the shooting were identified at the time of the incident as Officers M. Plaisted, V. Moreno and T. Schneider.
